Auction Terms of Sale

1. Registration

All bidding takes place in person at our Scarborough sale room — this website does not offer online bidding. Bidding is open to registered bidders aged 18 or older: register free on this website before the sale to receive your bidder number, and show it at the door to pick up your paddle. You are responsible for every bid you place. 51 Auction may refuse entry or bidding privileges at its discretion.

2. Bidding

Each lot sells to the highest bidder when the lot closes. A bid is a binding offer and cannot be retracted. In the event of a tie or a dispute, the auctioneer’s decision is final. 51 Auction may advance the bidding at its discretion, reject any bid, or withdraw or combine lots at any time.

3. Buyer’s premium and taxes

A buyer’s premium of 5% is added to the hammer price of every lot. HST (13% in Ontario) applies to the total of the hammer price plus the buyer’s premium. Example: a $100 winning bid totals $105 before HST.

4. Payment

Winning bidders may pay online or at pickup. We accept major credit cards, debit and Interac e-Transfer. Items are not released until payment is received in full.

5. Pickup and storage

Wins are collected at 115 Ironside Crescent Unit 11, Scarborough, ON M1X 1M1 during the pickup window stated on the invoice (typically within 3 business days of the sale). Please bring photo ID and your invoice number. Items not collected within the pickup window may be charged a storage fee of $5 per lot per day, and items unclaimed after 14 days are considered abandoned and may be resold without refund.

6. Shipping

Shipping is available on eligible lots at the buyer’s cost, quoted before dispatch. Title and risk pass to the buyer once the item leaves our facility.

7. Condition of items — all sales final

All items are sold as-is, where-is, with all faults and without warranty of any kind, express or implied. Descriptions and photographs are provided as a guide; every lot can be previewed in this website's catalogue before the sale. All sales are final — no returns, exchanges or refunds.

8. Liability

51 Auction is not liable for errors in the catalogue, interruptions to the live stream, or for injury or loss occurring on the premises except where caused by our negligence.

9. Changes to these terms

We may update these terms from time to time. The version posted on this page at the time of a sale governs that sale.
